Invoices:
Invoices are payable within 14 days of the date of issue.
Where an invoice is issued to and payable by a reputable or familiar solicitors’ firm I will usually be content (on request and where agreed) to be paid on a COMBAR B basis.
Where a Party does not have a solicitor representing them the invoice will be addressed to and payable by the Party itself in advance of the mediation.
Cancellation:
If any Party cancels the Mediation, the following proportion of the Mediator Fee will be payable by each Party:
If the cancellation is made two or less working days before the date of the Mediation, the full Mediator Fee; or
If the cancellation is made three to five working days before the date of the Mediation, 50% of the Mediator Fee; or
If the cancellation is made six to ten working days before the date of the Mediation, 25% of the Mediator Fee;
in each case without prejudice to a Party’s right to recover such sums from any Party it may consider to be at fault for the cancellation.
Additional Hours
Sometimes people want to keep negotiating late, or the parties want my help to keep negotiating over subsequent days. That is fine and will be charged at an hourly rate of £450 + VAT per hour. I won’t normally charge for a few minutes here or there. I’ll let you know before this meter starts.
Option 1: The 4 hour focus
£2,000 + VAT per party
A half-day(ish) mediation, fixed for 4 hours (if parties are very close we keep going). Mediator’s preparation and preliminary call with representatives is included.
This is best for costs mediations and prof neg mediations where the value in dispute is less than £100k.
Option Two: A full day
£3,500 + VAT per party
Sometimes a dispute will need a full day. Typically this is a prof neg claim with a number of issues or where the value is £100k+. It will also be suitable where parties are not familiar with mediation or are not experienced litigators in the area, multi-party cases or where there are cultural or personality issues which deserve more time. We take things at a slightly slower pace to make sure we get to the right answer. This fee assumes 8 hours mediating and preparation and a preliminary call as well. Again, if the parties are close we keep going.
Option Three: Three blind-bids
£250 inc VAT per party
Often parties know they want to deal but just need help getting to a number. A three blind-bid is a great route to cut to the chase. Both parties send me, confidentially, three offers in which they make increasing concessions (the last usually being the bottom line). I will compare them. In the (rare) event of a match between corresponding bids the parties agree to settle at that level. If there is an overlap I will tell them the mid-point and, again, they agree to settle at that level. If there is no overlap but the parties have made real progress then I will often encourage them to allow me to share with both sides the final offers. This is often enough to reach a deal.
